Data controller

This policy describes how your data is collected, used and protected when you use the Website. We have not appointed a data protection officer as this is not legally required.
Data collected
We collect: data provided at registration (name, email address, password in encrypted form, country, optionally phone number and city, account type); data about your listings (texts, photos, price, location) and your messages with other users; data about your use such as favourites, saved searches, reviews, reports and blocks; technical connection data (IP address, time, pages visited, browser and device type) in server logs; verification data (email or SMS confirmation code) and, if you voluntarily request an identity check, a photo of your ID document and a selfie. These images are used only for manual review and are deleted after the decision. When you open the Website, our server determines your country from your IP address in order to preselect listings and language; the IP address is neither stored for this purpose nor passed on to third parties.
Purposes of processing
Your data is used to: create and manage your account; publish and moderate your listings; enable messaging between users; ensure platform security and prevent fraud; send you notifications related to your activity (offers, messages, listing status); and improve our services.
Legal basis
Legal bases are: Art. 6(1)(b) GDPR (performance of a contract — providing your account and the platform features); Art. 6(1)(a) GDPR (consent — e.g. push notifications, optional cookies, identity check); Art. 6(1)(f) GDPR (legitimate interest — security, prevention of abuse and fraud, automated pre-screening of listings, server logs); Art. 6(1)(c) GDPR (legal obligations, e.g. tax-law retention). Information is stored on your device (e.g. login session, language setting) under § 25(2) TDDDG where strictly necessary, and otherwise only with your consent under § 25(1) TDDDG. Listings are automatically pre-screened for suspicious content; a human decides on suspicious listings. No decision based solely on automated processing that produces legal effects is made.
Data recipients
Your data is not sold. We use the following service providers as processors: IONOS SE (hosting, Germany); Cloudinary (storage and delivery of photos — when photos load, your IP address is transmitted to Cloudinary); Resend (sending emails, USA); for SMS verification Twilio (USA); Cloudflare Turnstile (bot protection at registration and listing creation, USA — scripts from Cloudflare are loaded when these forms are opened); for automated pre-screening of listing texts, where applicable, the OpenAI moderation interface (USA); for push notifications the push services of your browser or operating system (Google, Mozilla, Apple). When you open the map view, map tiles are loaded from OpenStreetMap (OpenStreetMap Foundation, United Kingdom), which transmits your IP address to that service. We deliver fonts ourselves. Other users see the information of your profile and listings that is displayed publicly; authorities receive data only where legally required.
Retention period
Your data is kept for as long as your account remains active, then deleted or anonymized within a reasonable period after its deletion, unless a longer legal retention obligation applies (in particular for accounting purposes or in the event of an ongoing dispute).
Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). You may withdraw any consent at any time with effect for the future (Art. 7(3) GDPR). You can exercise these rights via your account settings or by email to contact@souqmar24.com. To protect your data we may verify your identity first. You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Hessian Commissioner for Data Protection and Freedom of Information, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, Germany.
Cookies and trackers
The Website uses two categories of cookies: Essential cookies: required for the Website to function (keeping you logged in, remembering your language and your browsing country). These cookies are always active; without them, certain features of the Website cannot be used. Audience-measurement cookies: help us understand how the Website is used, so we can improve it. These cookies are only set with your consent, collected via the banner shown on your first visit. SouqMar24 does not currently use any advertising or social-media cookies. You can configure your browser at any time to refuse some or all cookies, which may limit certain features of the Website.
Data security
We implement reasonable technical and organizational measures (password encryption, secure HTTPS connections, access control) to protect your data against unauthorized access, loss or disclosure.
Transfers to third countries
Our servers are located in the European Union. Some of the service providers named above (e.g. Resend, Twilio, Cloudflare, Cloudinary, OpenAI) are based in third countries, in particular the USA, or process data there. The transfer relies on an adequacy decision of the European Commission (e.g. the EU-US Data Privacy Framework) or on standard contractual clauses under Art. 46 GDPR. The service is offered to users worldwide. We treat the data of all users according to the standards of the GDPR, regardless of where they live.
