Purpose
These Terms of Use ("Terms") set out the rules for accessing and using the SouqMar24 website, an online marketplace allowing individuals and businesses to publish, browse and negotiate listings.
Acceptance of the Terms
Accessing and using the Website implies full and unconditional acceptance of these Terms. If you do not accept these Terms, you must refrain from using the Website.
Registration and user account
Creating an account requires providing accurate and up-to-date information (name, email, phone number). You are responsible for keeping your credentials confidential and for any activity carried out from your account. An account is strictly personal and may not be transferred or shared. Registration is reserved for persons aged 18 or over.
Description of the service
SouqMar24 provides a space connecting users who wish to sell, buy, rent or offer goods and services. SouqMar24 is not a party to transactions concluded between users and does not intervene in the negotiation, payment or delivery of the goods or services advertised.
Rules for publishing listings
Each listing must correspond to a real good or service, be described accurately and without being misleading, and be published in the appropriate category. SouqMar24 reserves the right to moderate, recategorize or remove any listing that does not comply with these Terms or applicable regulations, without prior notice.
Prohibited content and conduct
It is prohibited to: publish listings for illegal, counterfeit, dangerous or regulated goods or services without authorization; publish false, abusive, discriminatory or fraudulent content; impersonate a third party; or use the Website for unsolicited mass solicitation (spam).
Paid features
SouqMar24 may offer paid options (highlighting, premium listings). Prices as well as payment, billing and refund terms are shown when you book. Prices are final prices: as a small business within the meaning of § 19 UStG the operator does not charge or show VAT. These options concern only services provided by SouqMar24 itself, not the transactions between users. The contract for a paid option is concluded once we accept your booking request or activate the option.
Liability
SouqMar24 makes every effort to ensure the availability and security of the Website, without guaranteeing continuous availability or the absence of errors. SouqMar24 cannot be held liable for damages arising from the use of the Website, transactions between users, or content published by third parties. Each user is responsible for exercising caution in their interactions.
Intellectual property
The structure of the Website, its features and editorial content are protected by intellectual property law. By publishing a listing, the user grants SouqMar24 a non-exclusive license to use, reproduce and display the content (text, photos) as necessary for the operation of the Website.
Suspension and termination
SouqMar24 may suspend or delete, temporarily or permanently, any account in the event of a breach of these Terms, without prior notice in the event of a serious breach. The user may delete their account at any time from the Website settings.
Protection of personal data
The processing of personal data in connection with the use of the Website is described in the Privacy Policy, which forms an integral part of these Terms.
Changes to the Terms
SouqMar24 reserves the right to modify these Terms at any time. Users will be informed of any material change. Continued use of the Website after a change constitutes acceptance of the new Terms.
Governing law and disputes
These Terms and the use of the Website are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected. In the event of a dispute an amicable settlement is sought first. The statutory places of jurisdiction apply to consumers; towards businesses the place of jurisdiction is the operator's registered seat. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. The German version of these Terms is authoritative; translations are provided for convenience only.
